Who should I name as my executor?

The legal requirements are generally that the person be over the age of eighteen and mentally competent. Some states also require that the person cannot be a convicted felon and must reside in the state that you live in (or else a local co-executor must be selected). Pretty low bar. However, there’s more to consider than just the simple legal requirements. Since it’s such a big responsibility, it should be someone you trust, who not only understands your final wishes but also has the ability and capacity to carry out those wishes (and is willing to!). Being the executor of an estate can be a time consuming process and is no small matter. Make sure you talk to (or at the very least, give some advance notice to) the person who you nominate and confirm that they’re on board!
